Job Introduction

The Business Affairs Executive is a critical member of the BBC Studios Scripted Business Affairs Team supporting flagship BBC drama programmes including Doctor Who, Casualty and Pobol y Cwm.

The role also includes supporting the Music and Events team in Wales producing live events such as BBC Young Musician, Proms in the Park and BBC Cardiff Singer of the World.

The successful candidate will work across a wide range of Rights, Legal and Business Affairs activities and will build and maintain first class relationships with external organisations, agents and talent and across BBC Studios and the BBC Group.

Mae’r rôl hefyd yn cynnwys cefnogi’r tîm Cerddoriaeth a Digwyddiadau yng Nghymru wrth gynhyrchu digwyddiadau byw fel Cerddor Ifanc y BBC, Proms yn y Parc a BBC Canwr y Byd Caerdydd.

Bydd yr ymgeisydd llwyddiannus yn gweithio ar amrywiaeth o weithgareddau Materion Hawliau, Cyfreithiol a Busnes a bydd yn meithrin perthynas o’r radd flaenaf â thalent, asiantau a sefydliadau allanol, ac ar draws BBC Studios a Grŵp y BBC.

Role Responsibility

  • Negotiating and contracting:  To provide high quality Legal and Business Affairs advice to BBC Studios Production teams and other BBC Group colleagues including, but not limited to, Production and Development Agreements within BBC Studios, Talent and Contributor Rights Agreements, Digital Media Contracts, Acquisition Agreements, Commercial Investment and Distribution Contracts and a Collaboration of Agreements with other creative and funding partners.
  • Rights management:  To advise on contributor fees, contract terms, employment of foreign artists, tax and service company issues, copyright clearance, writers and format deals, interpretation of Union agreements, framework agreements, negotiating fees and contracting ensuring the necessary rights are acquired for primary and secondary programme exploitation as required. To undertake complex copyright clearance to existing material, liaising with Production Departments and Worldwide to trace and clear copyright ownership.
  • Team management:  To provide management support to the Business Affairs Managers, which include responsibilities for recruitment, day-to-day management, training and the development of the current Business Affairs Assistants and other colleagues.
  • Support editorial and creative:  To support the Business Affairs team as required in advising editorial, production and finance staff of the key and relevant legal and business implications of programme ideas and offers. Including deal proposals, drafting and negotiating agreements and the continued work of dealing with internal clients throughout.
  • External third party relationships:  To maintain and build excellent relations with external contacts including agents, talent, commercial partners, independent producers,  BBC Worldwide and other rights-owning bodies to negotiate terms for investment and licensing of BBC Studios’ programmes and content.
  • Internal BBC relationships:  To build and maintain effective working relationships with BBC Group, to include departments such as Commissioning, Editorial Policy, Finance, BBC Commercial Rights and Business Affairs teams and the BBC Legal division to ensure maximum creative and business synergies.  To be able to effectively design, deliver and evaluate training for Production on performance rights.
  • Risk management:  To mitigate legal, contractual and business affairs risks, and build up brand and IP protection.  Proactively identify and manage risk.
  • Frameworks:  To work with the business affairs team to ensure applicable standards in deal making and rights acquisition are maintained. To manage accurate contract record keeping and rights reporting.
  • BBC Policy:  To work with relevant colleagues to ensure that all deal making is consistent with BBC Policy and Guidelines, Rights Frameworks and the BBC’s Fair Trading commitments.
  • Administration and maintaining records:  To conduct necessary department administration relating to contracts and related business documentation ensuring accurate and up-to-date record keeping. To authorise and over-see contractual payments within the financial authority of this post, dealing with any subsequent queries arising from individual contracts or agreements.
  • Systems:  To use the BBC’s ACON system (Contract Generation and Management), OnAir and other systems as required to manage up-to-date information to the applicable data integrity standards and to produce contractual documentation.

  • Rheoli hawliau:  Darparu cyngor ar ffioedd cyfranwyr, telerau contractau, cyflogi artistiaid o dramor, materion cwmnïau gwasanaeth a threth, clirio hawlfraint, bargeinion fformatau ac awduron, dehongli cytundebau Undebau, cytundebau fframwaith, ffioedd negodi, a chontractio gan sicrhau y ceir yr hawliau angenrheidiol ar gyfer ymelwa ar y brif raglen a'r elfennau ategol fel bo gofyn. Gwneud gwaith clirio hawlfraint cymhleth ar ddeunydd presennol, gan gysylltu ag Adrannau Cynhyrchu a Worldwide i olrhain a chlirio perchnogaeth hawlfraint.
  • Rheoli tîm:  Darparu cymorth rheoli i’r Rheolwyr Materion Busnes, sy’n cynnwys cyfrifoldebau am recriwtio, hyfforddi a datblygu'r Cynorthwywyr Materion Busnes a chyd-weithwyr eraill, a’u rheoli o ddydd i ddydd.
  • Cefnogi golygyddol a chreadigol:  Helpu'r tîm Materion Busnes fel bo gofyn i roi cyngor i staff golygyddol, cynhyrchu a chyllid ar oblygiadau cyfreithiol a busnes allweddol a pherthnasol syniadau a chynigion rhaglenni. Mae hynny’n cynnwys cynigion ar gyfer bargeinion, drafftio a thrafod cytundebau a’r gwaith parhaus o ddelio â chleientiaid mewnol drwyddi draw.
  • Perthnasoedd allanol trydydd parti:  Meithrin perthynas ardderchog â chysylltiadau allanol gan gynnwys asiantau, talent, partneriaid masnachol, cynhyrchwyr annibynnol, BBC Worldwide a chyrff eraill sy’n berchen ar hawliau i drafod telerau ar gyfer buddsoddi yn rhaglenni a chynnwys BBC Studios, a’u trwyddedu.

  • Fframweithiau:  Gweithio gyda’r tîm materion busnes i sicrhau y cyrhaeddir y safonau perthnasol wrth daro bargeinion a chaffael hawliau. Rheoli'r gwaith o adrodd ar hawliau a chadw cofnodion o gontractau.
  • Polisïau’r BBC:  Gweithio gyda chyd-weithwyr perthnasol i sicrhau bod yr holl fargeinion sy’n cael eu taro yn cyd-fynd â Pholisïau a Chanllawiau’r BBC, Fframweithiau Hawliau'r BBC ac ymrwymiadau'r BBC o ran Masnachu Teg.

The Ideal Candidate

The ideal candidate will have a good understanding of Business Affairs for the Television, Radio and Digital Media Industry and related BBC Policies and Strategies, with proven negotiating, influencing skills and legal / contracting experience.  An understanding of how programmes are made and the deals essential during this process are also required. 

The candidate will have a proven track record of having delivered projects within both time and budgetary constraints and a knowledge and understanding (or the ability to acquire such) of BBC Business Affairs contracting systems and processes.  An informed and broad understanding of Broadcasting and the Media are essential.

Where the candidate does not have relevant, direct experience or skills they will need to demonstrate the ability to learn and adopt the necessary knowledge and understanding.

The ability to speak Welsh is desirable for this role.
